Federal court to hear challenge over Texas border buoys

AUSTIN (Nexstar) — The state of Texas could soon be forced to remove its barrier of buoys along the Rio Grande River near Eagle Pass, if a federal judge agrees with the U.S. Department of Justice that Texas overstepped its constitutional authority by installing the flotation devices. The Biden administration filed suit against Gov. Greg Abbott in late July over the state’s floatation barrier, arguing it violates international and federal law. In the lawsuit, the DOJ said Texas’ construction of buoys in the river violates the Rivers and Harbor Act, as it obstructs the “navigable capacity” of U.S. water. The filing also notes Texas did not obtain a prior permit from the U.S. Army Corp of Engineers, as required by the act. Federal attorneys are asking the courts to stop Texas from putting any more barriers in the water and to remove the current 1,000-foot stretch of buoys at its own expense. U.S. District Judge David Ezra will hear arguments Tuesday morning. Abbott held a joint-press c...Tropical Storm Harold brings gusty winds, fire danger locally

I’m going to begin this column with a rather unusual reading recommendation. If you’ve got an afternoon to kill and want to read 126 pages of heavily footnoted legal argument and historical analysis, I strongly recommend a law review article entitled “The Sweep and Force of Section Three.” It’s a rather dull headline for a highly provocative argument: that Donald Trump is constitutionally disqualified from holding the office of president. In the article, two respected conservative law professors, William Baude and Michael Stokes Paulsen, make the case that the text, history and tradition of Section 3 of the 14th Amendment — a post-Civil War amendment that prohibited former public officials from holding office again if they “engaged in insurrection or rebellion” or gave “aid or comfort” to those who did — all strongly point to the conclusion that Trump is ineligible for the presidency based on his actions on and related to Jan. 6, 2021. ALBANY, N.Y. (NEWS10) -- Today's 98.3 TRY Social Dilemma came from Mellie and it's about sleepovers. Here's her email. Get the latest news, weather, sports and entertainment delivered right to your inbox! Hi Jaime. Here's a dilemma for you. My daughter is turning ten in two weeks and she wants to have a sleepover with five of her friends. One of her best friends is a boy who has been to sleepovers in the past, but my husband is saying that now she’s too old to have boys stay over. It’s not an unreasonable position for him to take, but our daughter is devastated. I’m conflicted on what the best thing to do here is. What’s the etiquette? What’s the age at which little girls can no longer have sleepovers with their friends who are boys? What would you do? Hope you can help. Thanks.MellieHmm, this is a tough one. But I do think since it's only one boy, and they've been best friends for a while, I would let him stay over. He would have his own sleeping bag or his own spot on the floor,...Siena Poll: Migrants, Biden, Trump, and Hochul

ALBANY, N.Y. (NEWS10) -- A new Siena poll released on Tuesday gave insight into the recent influx of migrants, migrant resettling, Gov. Kathy Hochul and President Joe Biden's ratings, and the recent indictment for former President Donald Trump. According to the poll, a majority of voters see the influx as a "serious" problem, with Hochul seeing a new high in unfavorable ratings. Dear Amy: My husband and I have been married for nine years. When we were newly married, we had the luxury of running after work and hiking on the weekends. We did not have a lot of stress.Fast-forward to two kids, a home, careers, and a life out of balance — and my husband has gained about 60 pounds.I am not judging him, as I completely understand the problem of stress eating, aging, and having too little time to work out.I’ll love him no matter what.My issue is his health. I’m terrified of him having a heart attack or a stroke. He is a smart guy and knows he needs to lose weight, but the problem is that he won’t try.He eats bags of cookies, brownies, and fast food. He refuses to go to the doctor because he says he “needs to lose weight first,” but he won’t make the effort to do so. He hasn’t had a physical in more than seven years.I cannot bring myself to tell him that he really needs to lose weight, as I don’t want to make him feel worse than I know he already does.I’m guessi...How many MEPs will each EU country get in 2024?
